We ( @KarlDahl ) had a conversation a while back about this.
A militia that does not have the recognition and protection of the local government is just a mercenary group waiting for the day they get declared to be insurrectionists. Colonial militias were formed and recognized by their respective colonial governments. 19th Century state militias were the same. The closest thing we have right now is Texas and Florida forming their own independent state guards.
Individual men forming unsanctioned paramilitary outfits was outlawed after the 30 years war. (They hanged all the mercenaries after the war)
If you want to go private/independent, you have to form it as a volunteer disaster response group or something like that.

Tucker grew up in an LA neighborhood known as hebrew heights. Up to his eyeballs in CIA and jews his whole life. He knows way more than he lets on.
I have noticed the same thing Dread mentioned, and it's not just Tucker. There is a laughably conspicuous rightward movement among the conservative gatekeeping legion, and all it has been making me suspect is that someone with enough intel to understand which way the wind is blowing has decided they have to get in front of this and try to steer it.
Not that there is one mind among them that has total consensus, but a substantial portion of them have conceded that too many horses have left the barn, and they have to try and play the field as it is.
