Plus, what's at issue would never really result in criminal charge in normal practice. Taxing authorities are in the business of collecting money. If there is a legal disagreement about a deduction, that's dealt with civilly, and if the taxpayer is wrong, they pay the tax, interest, and penalties. They don't go to jail.
Plus, relying on counsel's opinion is a fairly solid defense against criminal prosecution. It eliminates the required intent.
To go to jail for tax evasion, you have to do something really fucked up, like make a ton of money and never disclose it, e.g. Wesley Snipes. He didn't file at all.

Leftists have been doing a rash of these, and the right wing, even the hard right like fascists and the like, are generally reactionary in a very literal sense. For example, it took a lot of provocation to get rightists to the point where they stopped believing in freeze speech and decided it was time to just openly censor shitlibs. Consider that in 2015 leftists arguing from freedom of speech would have actually gotten somewhere with conservatives on the subject of exposing their kids to queerosexual propaganda in public schools. Not today. And it's because of the erosion of the expectation of free speech. That expectation is basically gone. So now rightists, even moderates, will fight tooth and nail on the subject of what kids are allowed to see in school, etc.
I believe that if they arrest Trump, even if the arrest doesn't really go anywhere from a legal perspective, that it will be crossing the Rubicon on political prosecutions. After this, the DeSantises of the world, for all their flaws, will openly say to their left wing judges, legislators, etc, that they will fall in line or they will get hit for XYZ crime and whatever else "we can get you on." They will treat minor transgressions that are on paper felonies as the Sword of Damocles on leftists. You will vote/rule/otherwise decide as commanded, or you will get a SWAT team at your door within 24hrs for, I don't know, felony possession of marijuana, since your medical card expired last week. Something like that. I don't know if that's how it actually works in florida, but the point is is that they will be threatened with SWAT teams over bullshit charges with no apology. Fuck around and find out.
Leftists act in defiance of good rules, written or unwritten, and think there are no consequences. Rightists demonstrate why those rules were created in the first place by systematically violating them once there is a course of them not being enforced. The reaction is the consequence.
