   I checked the CFAA, and it's not authorized access if it's publicly accessible and you don't do anything to end run their access controls. For example, using a VPN after getting ip blocked may be the most minimal type of activity that may constitute criminal hacking, because it avoids an access control. But if you always log in with the same ip, there's really no problem.
   
   So scraping, etc., is legal under the cfaa as long as you don't end run. Copyright and Trademark infringement due to the content acquired is a separate issue.

     Also, merely violating terms of use is not hacking. Courts have concluded that ToS' are not legislated penal law.
