     I've read many of thomas' opinions over the years. He may be black, but he's no nigger. On the bell curve, he's an outlier. Plus, from what I've seen of him, he seems really nice. He keeps his ego in check, unlike Ginsberg, who always came across as "I'm on the Supreme Court, who the fuck are you pleb?"

     Yeah the knowing falsity or reckless disregard for the truth standard is bullshit. It's allowed the type of blackmail media we have today. I don't think that was the intent. Thomas has expressed a desire to revisit the case when the proper case arises, and I assume he'd prefer one bording on blackmail. Maybe Elon is rich enough to get it certified before he's gone (based on recent opinions, Thomas is in philosophical control of the court at this time).

     Libel and slander have always been economic torts. It's about protecting reputation in a community so one can earn one's keep. This used to mean something to people. This is true even in the case of women who were accused of being unchaste (classic defamation per se). Such falsifies could interfere with their marriage prospects in the olden days, i.e. their ability to earn a keep.

     Idk if Elon is a soft enough target for the ADL to get pro-bono work out of their allies, otherwise they're going to need other wealthy Jews to pay for the lawsuit. Elon isn't some tv anchor or radio show host, he's the richest man on earth. Whose pockets are deeper? Who is willing to spend more? ADL has been in hot water with other Jews for making them look bad for some time now, will they have as many allies as they think they do? Idk.
