   @Humpleupagus This comic seems like it’s getting mad at Trump for exactly the wrong reason. What exactly was he supposed to do about this? Doing some coordinated general pardon of all those people that went into the Capitol during the 2-week interval between certifying the vote and Trump leaving office would have likely resulted in a rushed impeachment, and would have been justified TBH.

   That being said, while those people are idiots for idolizing Trump to such a degree and falling for the “stolen election” BS, they never would have gone to prison if Trump and his cronies hadn’t lied to them in the first place. That is what they should be mad at Trump for.

     @dave @Humpleupagus I don't think anyone expects a pardon, but I don't think he's ever even mentioned the people who got caught up. I think some people feel betrayed because of this. To hear trump tell it the only person wronged that day was him.

     @dave @Humpleupagus 2020 disenfranchised a lot of young people. I know kids who were finally of age to vote only to end up in the messiest and most suspicious election in my lifetime. Then some went to DC on the 6th. Luckily they didn't go inside but they still had to wonder for months if they were getting scooped up just for showing support for their chosen president.

     He could have given midnight pardons like presidents often do. Even if he had though, they probably wouldn't have been delivered, because Bill Barr would have refuse (I assume the AG would be tasked with delivering pardons). Then Biden would pocket them. See Marbury v. Madison.

     @Humpleupagus @thatguyoverthere @dave I've always thought it was ridiculous for people to think Trump would have been able to pardon anyone at that point in his presidency. He effectively had no power, no one listened to him anymore, and Pelosi overrode him at will. This was not a transfer of power, it was a bona fide coup.

     He could pardon. That power is absolute. Delivery is the issue. And like you said, no one was listening to him, so timely delivery of any such pardons would have been unlikely.

     @Humpleupagus @CrustyB @thatguyoverthere No, it isn’t. That pardoning power is enshrined in the constitution, but the POTUS can only pardon federal crimes. There are still state crimes on the books that many of them can get charged with, and you can bet that a sufficiently-motivated prosecutor would be digging through old laws to find something to charge them with.

     And you can bet that a state prosecutor would feel that pressure, given how “federal funding” operates as a loophole to the 10th Amendment, an explicit example of which would be how states were forced to kowtow to MADD and raise their BAC limits for fear of losing funding for their roads.

     I support this, of course, since ignoring the 10th Amendment is called “being a good person” and all.

     @dave @Humpleupagus @CrustyB @thatguyoverthere So weird how the power of Presidential Pardon was acknowledged by everyone to be universal until libs decided they wanted to put Trump and his supporters in jail no matter what and then suddenly all these conditions and limitations magically appeared. Nobody was like "Oh shucks, Ford might have pardoned Nixon but we're still gonna get him on the state level!!"

     We are talking about people being prosecutied for peacefully walking in a public space. This was such a clown show, that one more formality like a presidential pardon would change nothing anyway.

     I think you misunderstood by what I meant when I said it's absolute. I meant it cannot be limited by any other branch and blanket pardons are legal. See Ford's pardon of Nixon.
     
     Civil matters, whether state or federal, and state crimes cannot be pardoned by the president. That's a given.
