The question isn't whether they have the legislative power to destroy it (they don't give a shit about constitutional protections) it's whether they have the power to destroy it in practice.
They can significantly cripple it by shutting down US based exchanges and possibly other draconian measures, but they can't erase the blockchain and they can't shut down the network without completely shutting down the internet.
The gold order worked because gold possession was centralised and they could simply order the banks to hand over records of who did/had recently deposited there. That doesn't really apply to crypto.Woggy's Zeonic Frolicks likes this. -

Prices will probably fall and a bunch of exchanges will go down, but the basic structure of crypto is resiliant against this kind of attack, which is why it got popular in the first place. -

If that’s not enough (it is), a large variety of other regulatory tools are already in-place for immediate use.
The US government has control mechanisms in-place to intercept and examine all internet data and commerce within it’s borders. Any crypto that’s viewed as a threat will be mercilessly crushed before rollout out of the CBDC.
Precedent for this was established in 1933. Any crypto can be destroyed with unimaginable effectiveness using one single stroke-of-a-pen.
